Rental Deposit Before Viewing in Korea: Scam Red Flags

A request for a small holding deposit before a viewing is not automatic proof of fraud in Korea, but it is a serious risk signal. Do not transfer until you can verify the exact unit, owner, broker, documents, payment account, essential terms, and written refund conditions.

A request to send money before seeing a rental is not automatic proof of fraud in Korea, but it is a serious risk signal. The safest answer is simple: do not transfer money just because someone says the room will disappear. First verify the exact unit, the person entitled to rent it, the licensed broker, current property documents, the receiving bank account, the essential deal terms, and the refund conditions in writing.

Korean agents and landlords sometimes call an early payment a gagyeyakgeum (가계약금), often translated as a provisional, reservation, or holding deposit. The label does not create a universally harmless category. A small transfer can become a real dispute over whether a lease was agreed and whether the money must be returned. This guide gives a risk-screening process, not individual legal advice.

The line is verification, not the amount

A legitimate listing can create time pressure, especially in a competitive neighborhood. That still does not make an unverified transfer safe. A broker should be able to identify the property and the parties, show the unit, explain what the payment does, and document the conditions. If the only proposition is “send money now and we will sort out the details later,” stop.

The risk is not limited to a large jeonse deposit. It also applies to a smaller wolse holding payment. A scammer can profit from repeated small transfers, while a genuine landlord can still disagree with you about whether a non-refundable agreement was already made. Do not rely on phrases such as “just a reservation,” “only 100,000 won,” or “everyone does it.” Ask what exact legal and practical commitment the money creates.

A provisional deposit may have legal consequences

Korea’s Supreme Court considered a case in which a prospective tenant paid KRW 3 million while negotiating an apartment lease, then stopped before signing the formal contract. The Court explained that treating a provisional deposit as cancellation money that can simply be forfeited requires a clear agreement, assessed from the wording, circumstances, purpose, and parties’ true intentions. The official 2022 Supreme Court case summary is a warning against both easy assumptions: payment is not automatically meaningless, and the recipient cannot automatically keep it merely by calling it a provisional deposit.

Before any transfer, put the essentials in one written record:

  • The full property address, building name, floor, and exact unit
  • Whether the deal is jeonse or wolse, with the total deposit and monthly rent
  • The proposed lease term and move-in date
  • The amount being paid now and who receives it
  • Whether it is part of the deposit, a separate fee, or something else
  • The deadline for signing the formal contract
  • Every condition that produces a full refund, partial refund, or forfeiture
  • What happens if the owner, registry, building record, liens, guarantee eligibility, or actual unit differs from what was represented

A chat receipt showing only “reservation deposit received” is not enough. If the other party will not state the terms clearly, do not use the transfer as a way to discover them.

Red flags that should end the conversation

One warning sign may have an innocent explanation. Several together should make the decision easy. Walk away when the agent, owner, or advertiser:

  • Refuses an in-person viewing and will not provide a live video walkthrough of the exact unit
  • Uses only chat, avoids a voice or video call, or will not provide a verifiable office identity
  • Says another tenant is waiting and gives you minutes to pay
  • Refuses a fresh certified registry copy or building ledger, or says those checks can wait until after payment
  • Gives a landlord name that does not match the registry
  • Requests payment to an unrelated person, overseas account, cash channel, cryptocurrency wallet, or account whose holder cannot be explained and verified
  • Claims to act for the owner but cannot show a valid power of attorney and the owner’s supporting identification
  • Advertises a deposit or rent far below comparable homes without a credible reason
  • Dismisses liens, a trust registration, an illegal-building notation, tax arrears, or guarantee eligibility as paperwork that does not matter
  • Will not write down the refund conditions

A polished app listing, business card, office photo, or Korean bank account does not replace these checks. Screenshots and documents can be altered, so obtain important records through official channels or verify them independently.

If you must reserve remotely

Sometimes a newcomer is abroad, arrival is close, and temporary accommodation is expensive. The lower-risk alternative is to book short-term lodging and view rentals after arrival. If you still decide that remote reservation is necessary, reduce the unknowns before paying.

Use a registered real-estate office and verify that the person handling the deal is connected to it. Ask for a live walkthrough that begins outside, shows the building entrance and unit number, and continues through the exact interior without cuts. Compare the layout and defects with the advertisement. Do not accept a prerecorded clip as proof that the caller controls the unit today.

Obtain a fresh certified copy of the property registry and the building ledger independently. Match the address, unit, owner, building use, and any violation notation. Verify the owner directly through a channel you did not receive only from the advertiser. If a proxy is involved, get qualified help checking the power of attorney and identification. Confirm the receiving account holder before transfer and keep the transfer memo specific.

Finally, insist on a dated written record of all essential terms and refund triggers. Preserve the listing, messages, video-call details, documents, account information, and receipt. Verification lowers risk; it does not turn a remote deal into a guarantee.

The official pre-contract checks still come first

Seoul’s current jeonse-fraud prevention checklist tells tenants to check the market price and jeonse ratio, senior rights in the certified registry, the building ledger, landlord identity, the registered broker, contract language, and special clauses. It also says payment should go to an account in the landlord’s name. These are pre-contract checks, not tasks to postpone until after a holding transfer.

The first Seoul card says to obtain the registry again immediately before final payment and compare it with the contract-date record. The second shows the safer completion sequence: under the broker’s coordination, confirm the transfer and immediately exchange the keys and possession. They illustrate a useful principle—verification is a repeated process, not a one-time screenshot.

For jeonse, also compare the deposit with reliable market information, examine prior claims and trust ownership, ask about legally available landlord tax information, and check guarantee eligibility before committing. Get an independent person into the process

Check the current district contact and eligibility before relying on a particular time.

Even when that program does not fit, an independent licensed broker, housing counselor, or Korean-speaking adviser can slow down a pressured transaction and compare names and documents. Independence matters: do not let the person requesting the money be your only source of translation, verification, and legal interpretation.

If you already sent the money

Do not send a second payment to “unlock” a refund, pay a tax, or fix a document problem. Save the original listing, full chat export, emails, call logs, property photos, documents, bank details, transfer receipt, and the exact wording used before payment. Ask for the refund in writing and state the deadline, but do not threaten or invent legal claims.

Independently check the property, owner, broker registration, and receiving account. If the identity or property appears fabricated, someone is impersonating the owner or broker, or you believe money was obtained by deception, call Korea’s police emergency number 112. For a contract disagreement over whether the money is refundable, seek individual advice from a qualified Korean lawyer or an official legal-aid service; the answer can depend on the complete conversation, not just the payment label.

After a real lease is signed, complete the applicable lease report, fixed-date process, move-in registration, and guarantee steps promptly, and recheck the registry before final payment. But the most valuable protection happens earlier: never use money to substitute for a viewing, identity check, document check, or written agreement.
